This Privacy Policy Statement outlines the practices of Pantometrics, Ltd., its subsidiaries, and affiliates (collectively "Pantometrics") regarding the collection, use, and disclosure of information collected from you by means of our network of services, products and programs through the Fitclub suite of software (collectively "Fitclub Services") including those located on the www.Pantometrics.com website (the Website, collectively with the Fitclub Services as the "Pantometrics Site"). By using the Fitclub Services you consent to the collection and use of your information in accordance with the terms of this Privacy Policy Statement. If you do not want your information collected and used in the manner described in this Privacy Policy Statement, you can opt out by not participating in the Fitclub Services.

This privacy policy describes what information we gather from you, how we use that information and what we do to protect it. We hope that this privacy policy is straightforward and clear, but if you have any questions about it, please contact Pantometrics.

Children's Privacy Policy. Pantometrics does not knowingly collect personally identifiable information of children under the age of thirteen. Because Pantometrics is committed to protecting children's privacy online, use of the Pantometrics Site by children under the age of thirteen who live in the United States is prohibited.

Information that Pantometrics Collects. Pantometrics primarily collects information from website visitors, from gyms, and from Fitclub. What information we collect, and how we use it, depends upon the products or services used.

Website Visitors. Pantometrics collects non-personally identifiable, anonymous information from all visitors to the Pantometrics Site. The exact information we collect may vary, but can include a user's IP (Internet protocol) address, browser type, and the date and time a user accessed the Pantometrics Site. We use this anonymous information for system administration purposes in order to enhance the operation of the Pantometrics Site and make it more useful to visitors. We may share this information with outside parties, but each user's personal identity remains anonymous. We do not associate this statistical information with your personally identifiable information.

Pantometrics may also track the referring URL of our users to provide statistical information regarding the effectiveness of our site and marketing programs. Pantometrics does not share this information with outside parties except as indicated in the "Information Sharing" section below.

From time to time, we may use an outside agent to collect anonymous user information. The collection and use of such information will be for purposes substantially identical to those described above. As part of this service, the outside agent may use cookies. See below for an explanation of "cookies."

In certain areas, visitors will also be given a choice to be included on mailing lists. If you choose to be included on the mailing list(s), we may notify you about important changes to the Fitclub Services, and special offers we think you'll find valuable. Pantometrics may use a registration form for users to request information on our products and services. We collect visitor's contact information (like their email address). Contact information from such a registration form may be used to send information and promotional material to our customers. The contact information is also used to contact visitors when necessary. Users may opt-out of receiving future mailings [see the choice/opt-out section below].

Gyms and Health clubs. When you request information on products or register on the Pantometrics Site, we may require you to provide your name, e-mail address, mailing address, phone number and relevant information about the business. Pantometrics uses this information to communicate with health clubs, to allow Fitclub members to identify their gym membership, and to group information and reporting for health clubs.

Fitclub Members. In order to become a member of Fitclub and access the members only services, we ask you to register a username and password, and to provide your name, mailing address, e-mail address, gym membership, and gender, and perhaps other personal information. This information allows Pantometrics to identify you as a member/user. This Registration Information requires personally identifiable information because we need it to distinguish you from other users, to provide the Fitclub services, and to contact you directly for administration, passwords, billing, reporting, and other issues.

Ordering. At certain times you may also buy products and register for services through the Fitclub Services. If you make such purchases, we need to gather information relating to the sale, including what you are buying, how you are paying and where you would like the products shipped. However, we will use that transactional information only to complete the transaction, to provide you with an order history and to facilitate future orders. Pantometrics may use a third party vendor to process, package or shop your order, or to process your payment. Pantometrics may disclose your contact and financial information to outside vendors as necessary to process your transaction.

Fitclub Fitness Tracking Information. Fitclub Services tracking tools allow you to save your own personal fitness tracking information so that you can track your workouts, nutrition or other private information ("Fitness Tracking Information"). This information is linked to your Member Registration Information. Once your Fitness Tracking Information is separated from any personally identifiable information we may use the aggregated information for other reporting purposes.

Your Specific Communication with Pantometrics. We may receive additional personally identifiable information from you through voluntary communications with the Pantometrics Site. If so, we will use that information to fulfill your request and for aggregate reporting. For example, if you e-mail the Pantometrics Site to ask about an article or tool, we will use that information to give you an answer, to make sure that you are satisfied with our answer, to have a history of our service to you and to make our service better by reporting your request, without any personally identifying information, in our customer service totals.

Information Related to Special Offers and Promotions. Pantometrics may, from time to time, collect other information from you (for instance, when we make special offers, hold promotions, or conduct surveys). Information collected by these means is used internally for purposes such as marketing, customer administration, technical administration of the Pantometrics Site, or to contact you. Pantometrics does not share this information with outside parties except as indicated in the "Information Sharing" section below.

Cookies. A cookie is a small amount of data placed on your computer's hard drive that enables Pantometrics to recognize your computer/browser and to provide services. Cookies are used to deliver content that is specific to your interests, to streamline the login process, and to collect anonymous user data in the aggregate. The cookies make your use of the Pantometrics Site easier by making the Pantometrics Site run more smoothly, and by helping us to maintain the security of the Pantometrics Site. You do not need to have cookies turned on to use the Pantometrics Site.

We may use both session ID cookies and persistent cookies. A session cookie is temporary and terminates automatically after you close your browser. A persistent cookie remains on your hard drive, but can be removed by following the directions in your browser's Help section. Cookies allow you to take full advantage of Pantometrics Site features and we recommend that you leave them turned on.

If and when Pantometrics allows third party vendors to sell or advertise through the Fitclub Services, they may use their own cookies, and Pantometrics has no access to, or control over, these cookies.

Public Information. The Pantometrics Site may provide you with many ways to submit information to be posted on our site including participation in forums and asking our experts questions. Be aware that anything you submit to the Pantometrics Site through these services may be made public, so please do not include any information you might want kept private. Pantometrics takes no responsibility and assumes no liability for any content posted by you or any third party. Pantometrics has the right but not the obligation to monitor and edit or remove any activity or content. If you do post content or submit material, and unless we indicate otherwise, you grant Pantometrics and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Pantometrics and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose.

Information Submitted to Third Parties. If and when, Pantometrics allows third party vendors to sell or advertise through the Fitclub Services, those third party vendors may also request personal information. Any of your personal information provided for such transactions will be subject to such vendors' policies regarding their use of personal information. You should carefully review their privacy statements and other conditions of use. We may also use information about the transaction for aggregate reporting, marketing, customer administration and technical administration of the Pantometrics Site (summarized report data will not contain personally identifiable information).

Some features of the Fitclub Services may be made possible through Pantometrics' partnerships with outside parties. Pantometrics will ensure, for those features, that the outside parties providing them are clearly identified. As part of your use of these features, you agree to permit your personal information to be shared with these parties subject to these parties' policies regarding use of personal information, if any. Information about our customers is an important part of our business, and we are not in the business of selling it to others. Pantometrics uses great care in selecting business partners with whom we share your information. We require that our partners respect your privacy and not disclose your information to other organizations without your consent, but beyond that, our partners' use of information you voluntarily submit to them is governed by their privacy policies. Pantometrics is not a guarantor of outside parties' practices regarding your information. Users of the Pantometrics Site who permit the sharing of their personal information do so at their own risk, and shall not hold Pantometrics responsible for acts or omissions of outside parties.

We may work closely with third party businesses. You will be informed when a third party is involved in your transactions, and we share customer information related to those transactions with that third party.

We may also employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, etc. They have access to personal information needed to perform their functions, but may not use it for other purposes.

Information Release for Legal Purposes. We release account and other personal information when we believe release is appropriate to comply with the law. Pantometrics will disclose your information when we believe in good faith that it is legally required, such as pursuant to a warrant, subpoena, or court order, or to protect our rights and property. Further, we may reveal user information as necessary if we believe that the user is harming or interfering with other Pantometrics Site users, anyone else, or violating (either intentionally or unintentionally) our Member Agreement, or infringing any of Pantometrics Site rights, or trespassing on, damaging, or abusing any of Pantometrics Site property.

In the event that Pantometrics is acquired by or merged into another company, all information collected will be transferred to the acquiring company as one of Pantometrics' assets and will be governed by the acquiring company's privacy policy, if any.

Security. Pantometrics takes precautions to protect your personal information from unauthorized access, use, or disclosure. The personally identifiable information you provide is stored on servers located in a controlled environment that Pantometrics takes efforts to protect from unauthorized access by both physical and electronic measures. Pantometrics strives to provide a commercially reasonable degree of security, but does not guarantee that such measures will be effective.

Your Pantometrics account is password protected so that only you may use it. We recommend that you do not divulge your password to anyone and Pantometrics will never ask for your password by phone or e-mail. Also remember to log out from Pantometrics and close your browser window when you have finished your workout to ensure that others cannot access your personal information and correspondence.

We may put in place any one of a number of industry standard security measures to make sure your data is safe from loss, misuse, or alteration. Our team reviews our security system regularly, and regularly upgrades it to keep your data safe.

Pantometrics' employees and contractors are only given access to member data on a password-protected basis. It is our employment policy that this information is to be treated with the utmost confidentiality, and any misuse of this information is grounds for disciplinary action, including termination and prosecution to the full extent of the law.

While Pantometrics takes reasonable steps to secure your personal information, no system is fault proof. If Pantometrics' security systems are breached Pantometrics may attempt to notify you electronically. By using this web site or providing personal information to us you agree that we can notify you electronically. Pantometrics may post a notice on our web site if a security breach occurs. If this happens, you will need a web browser enabling you to view the Pantometrics Site. Pantometrics may also send an email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should email our Chief Privacy Officer. If your email address changes, and you have provided Pantometrics with personal information, you should notify our Chief Privacy Officer so that we can communicate with you if necessary.

Accessing and Changing Your Information. Pantometrics is committed to ensuring that you have significant control over your Registration and Fitness Tracking Information. You can change your password and other Registration Information using the Member Services page on Pantometrics.com. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.

Correction/Updating Personal Information, Opting-Out, and Contacting Pantometrics. You may use the contact information provided below if you have any questions, comments, or complaints about this Privacy Policy Statement or your dealings with the Pantometrics website or any Fitclub Services.
